Terms of Service

The rules that govern your use of the Drive GT360 app and the GT 360 web platform.

These Terms of Service (the "Terms") form a binding agreement between you and GT 360 ("GT 360", "we", "us") and govern your access to and use of the Drive GT360 mobile application and the GT 360 web platform at gt360.app (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Acceptance of Terms

By creating an account, signing in, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. The Services

GT 360 provides a ground transportation management platform for fleet operators and a companion mobile application ("Drive GT360") for professional drivers authorized by those operators. Functionality includes real-time driver location and dispatch, trip assignment and tracking, alerts, and operational reporting. We may add, modify, or remove features over time.

3. Accounts & Eligibility

The Drive GT360 mobile application is a workforce tool and is not intended for the general public. Driver accounts are provisioned by an authorized administrator of an organization that subscribes to GT 360. You must:

  • Be at least the age of majority in your jurisdiction.
  • Provide accurate, current information when prompted.
  • Keep your credentials confidential and accept responsibility for all activity under your account.
  • Notify us promptly of any unauthorized use of your account.

Your organization may suspend or remove your account at any time. We may suspend or terminate accounts that violate these Terms or applicable law.

4. Acceptable Use

When using the Services, you agree not to:

  • Use the Services for any illegal, harmful, or fraudulent purpose.
  • Attempt to interfere with, disrupt, or gain unauthorized access to the Services or related systems.
  • Reverse engineer, decompile, or attempt to derive source code from the Services, except where permitted by applicable law.
  • Resell, sublicense, or commercially exploit the Services without our written consent.
  • Use the Services to harass, harm, or impersonate any person or to transmit unlawful content.
  • Operate any motor vehicle in an unsafe manner while interacting with the app. You are solely responsible for safe operation of your vehicle and for following all traffic laws.

5. Intellectual Property

The Services, including all software, designs, text, graphics, logos, and other content, are owned by GT 360 or its licensors and are protected by intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. No other rights are granted.

6. Privacy

Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your information, including precise location and motion data from the mobile app.

7. Third-Party Services

The Services may rely on or display content from third parties (for example, maps, weather, flight tracking, and notification providers). We are not responsible for third-party content or services and do not endorse them. Your interactions with third parties are governed by their own terms.

8. Disclaimer

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from a course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

To the maximum extent permitted by law, GT 360, its affiliates, and their respective officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our total aggregate liability for any claim related to the Services is limited to the amount paid (if any) by you or your organization to us in the twelve (12) months preceding the event giving rise to the claim.

10. Termination

You may stop using the Services at any time. We or your organization may suspend or terminate your access immediately, with or without notice, for any breach of these Terms, applicable law, or operational necessity. Sections intended to survive termination (including Intellectual Property, Disclaimer, Limitation of Liability, and Governing Law) will continue to apply after termination.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the "Last Modified" date above. Continued use of the Services after an update constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky and the federal laws of the United States applicable therein, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms shall be resolved in the courts located in Kentucky, and you consent to the exclusive jurisdiction of those courts.
